PTAB Institutes IPR on University of Maryland’s Cardiac Valve Repair Technology

June 3, 2016 – Patent Trial and Appeal Board Administrative Patent Judge James A. Worth issued a decision on May 24, instituting inter partes review of the University of Maryland, Baltimore and Harpoon Medical, Inc.’s U.S. Patent No. 7,635,386, entitled “Methods and Devices for Performing Cardiac Valve Repair” in Case IPR2016-00208 based on the petition filed by Neochord, Inc.  APJ Worth, along with panel members Sally C. Medley and Erica A. Franklin, instituted the IPR based on anticipation and obviousness challenges to the claims of the ’386 patent, stating that Neochord’s petition “demonstrated a reasonable likelihood of prevailing on its assertion that claims 1-23 of the ’386 patent are unpatentable.”  The ’386 patent is directed to methods for performing repairs to cardiac valves.
