Motion for Summary Judgment over Standing Denied in Part, Granted in Part

June 27, 2016. Plaintiff AngleFix, LLC sued Defendant Wright Medical Technology, Inc. for patent infringement. Plaintiff’s U.S. Patent No. 6,955,677 is titled “Multi-angular fastening apparatus and method for surgical bone screw/plate systems.” The court partially denied Defendant’s motion for summary judgment that Plaintiff, a licensee, lacked constitutional standing because there is a genuine dispute of material fact whether Plaintiff breached the license. The court partially granted Defendant’s motion for summary judgment that Plaintiff lacked prudential standing because Plaintiff did not join the patent owner in the suit. The court ordered Plaintiff to join the patent owner within 30 days of the order. The case is pending in the Western District of Tennessee and is captioned AngleFix, LLC v. Wright Medical Technology, Inc., 2:13-cv-02407.
