USPTO Institutes an Inter Partes Review of Vite Technologies, Inc.’s Patent

June 29, 2016 – Arthrex, Inc. and Smith & Nephew, Inc. (collectively “Arthrex”), filed a petition for inter partes review of multiple claims of Vite Technologies, Inc.’s (“Vite”) patent. Arthrex argued that the claims are unpatentable under 35 U.S.C. §§ 102 and 103 over prior art publications. The USPTO issued a decision on June 23, 2016 finding that the information presented in the Arthrex’s petition establishes a reasonable likelihood that Arthrex will prevail in showing that claim 24 of Vite’s patent is unpatentable. The patent at issue is U.S. Patent No. 6,648,892, entitled “Soft tissue securing anchor.”

The petition is pending in the United States Patent Trial and Appeal Board and is captioned: Petition for Inter Partes Review by Smith & Nephew, Inc., PTAB-IPR2016-00381.
