June 28, 2016—Administrative Patent Judge Garth D. Baer instituted an IPR for U.S. Patent No. 7,954,021 (“Multi-Mode Cone Beam CT Radiotherapy Simulator and Treatment Machine with a Flat Panel Imager”), directed towards a clinical therapy stimulation machine capable of manipulating a CT radiation source and flat-panel imager to generate x-ray images. The ’021 Patent is owned by Varian Medical Systems, Inc., and the petition for IPR was filed by Elekta, Inc. In his decision, Administrative Patent Judge Baer ruled that claims 57-59 of the ’021 Patent were unpatentable under 35 U.S.C. §102 and §103.
