On July 15, 2016, the U.S. District Court for the District of Massachusetts issued a final decision granting Plaintiff’s (Body Science LLC) motion for entry of final judgment that the Defendant’s (Polar Electro Inc.) products do not infringe any of the asserted claims of U.S. Patent Nos. 6,289,238 (“the ‘238 Patent”) and 7,215,991 (“the ‘991 Patent”). In the underlying case, the Plaintiff had brought suit for infringement of the patents against the Defendant. Both the ‘238 Patent and the ‘991 Patent are drawn to electronic systems for wireless monitoring of patient body functions. In the decision, the Court (i) granted Defendant’s motion for summary judgement as to infringement, (ii) denied Defendant’s motion for summary judgment as to invalidity as moot, and (iii) granted Plaintiff’s motion for entry of final judgment. This case remains pending and is captioned 1:12-md-2375.
