CareFusion Files 3 IPRs Against Baxter International Related to Infusion Pump Patents

July 20, 2016 – CareFusion Corp. filed three petitions for inter partes review against patent owner Baxter International, Inc. on July 19, 2016 related to Baxter’s patents for a medical infusion pump and related technology.  The patents at issue are U.S. Patent No. 5,782,805, entitled “Medical Infusion Pump,” U.S. Patent No. 5,764,034, entitled “Battery Gauge for a Battery Operated Infusion Pump,” and U.S. Patent No. 6,231,560, entitled “Method and Apparatus for Automatically Controlling the Level of Medication.”  These patents are the subject of Case IPR2016-01456 (’805 patent), Case IPR2016-01460 (’034 patent), and Case IPR2016-01463 (’560 patent).  CareFusion is challenging the claims of Baxter’s patents on the grounds of anticipation and obviousness.  CareFusion and Baxter are currently involved in the district court action Baxter Int’l, Inc. v. CareFusion Corp. and Becton, Dickinson and Co., No. 1:15-cv-9986 (N.D. Ill. Nov. 9, 2015), involving the same patents.  The patented technology relates to medical infusion pumps, medical devices used to deliver fluids into a patient’s body.
