EMI Emergency Medical International Asks for Sanctions

July 21, 2016 – EMI Emergency Medical International asked for sanctions against Tactical Medical Solutions and its attorneys for bringing a patent infringement lawsuit involving a tourniquet device that EMI claims Tactical Medical stated it was not infringing during patent prosecution.  In its motion, EMI argued that the accused infringing tourniquet has a flexible base, the patents-at-issue claim a tourniquet having a “substantially rigid base,” and Tactical Medical expressly disclaimed during prosecution tourniquets with a flexible base.  The patents-at-issue are U.S. Patent Nos. 7,776,064 and 8,303,620.

The case is captioned Tactical Medical Solutions, Inc. v. EMI Emergency Medical International, in the Northern District of Illinois, 14-cv-6035.
