Howmedica’s Patents Invalid after Federal Circuit Appeal

July 29, 2016 – The Court dismissed Plaintiff Howmedica Osteonics Corporation’s (“Howmedica”) claims for patent infringement against Defendant Zimmer, Inc. (“Zimmer”) with prejudice and found the patents invalid. The final judgment follows an appeal from reexamination proceedings in which the Federal Circuit found Howmedica’s patent, U.S. Patent No. 6,818,020, invalid; and further follows the Federal Circuit’s decision affirming the grant of Zimmer’s motion for summary judgment of invalidity of the asserted claims of Howmedica’s other asserted patents, U.S. Patent Nos. 6,174,934; 6,372,814; and 6,664,308. The patents-at-issue are entitled “Non-oxidizing Polymeric Medical Implant.” The case is Civil Action No. 05-CV-00897 before the United States District Court for the District of New Jersey.
