Court Requires Joinder of Patent Owner

August 4, 2016 – The court denied Plaintiff Anglefix’s motion for an order allowing it to present a waiver of claims from the patent owner, the University of North Carolina (UNC), in place of joining UNC as a co-plaintiff.  The court reasoned that “UNC must be joined because Plaintiff is an exclusive licensee without prudential standing to sue on its own, not because UNC could otherwise bring suit against Defendant.”

The patent-at-issue is U.S. Patent No. 6,955,677, titled “Multi-Angular Fastening Apparatus and Method for Surgical Bone Screw/Plate Systems.”  The case is captioned Anglefix, LLC v. Wright Medical Technology, Inc., in the Western District of Tennessee, Western Division, 13-cv-02407.
