Complaint filed by Fisher & Paykel Healthcare Limited against ResMed Corp.

On August 15, 2016, Fisher & Paykel Healthcare Limited (“Plaintiff”) filed a complaint against ResMed Corp. (“Defendant”).  In the complaint, the Plaintiff is asserting infringement of U.S. Patent Nos. 8,443,807 (“the ‘807 Patent”), 8,479,741 (“the ‘741 Patent”), 8,186,345 (“the ‘345 Patent”), 8,453,641 (“the ‘641 Patent”), 9,265,902 (“the ‘902 Patent”), 8,550,072 (“the ‘072 Patent), 8,091,547 (“the ‘547 Patent”), 7,111,624 (“the ‘624 Patent”), and 6,398,197 (“the ‘197 Patent”).  The ‘807 Patent, the ‘741 Patent, the ‘345 Patent, the ‘641 Patent, the ‘902 Patent, the ‘072 Patent, the ‘547 Patent, the ‘624 Patent, and the ‘197 Patent are all assigned to the Plaintiff and are drawn to breathing assistance apparatus, apparatus for supplying and/or measuring properties of gases supplied to a patient, water chamber and/or apparatus for delivering humidified gases.  The Plaintiff is asserting that the Defendant is infringing the asserted patents by making, using, offering for sale, and/or selling one or more airway products, including the Airsense 10 Series products, the Aircurve 10 products, ClimateLineAir heated air tubing, and/or nasal pillow masks of the Defendant.  The case remains pending and is captioned 2-16-cv-06099.
