PTAB Rules Claims Covering Tissue Grafts Unpatentable

August 18, 2016 – The Patent Trial and Appeal Board (PTAB) has ruled that MiMedx Group’s U.S. Patent No. 8,372,437, related to placental membrane tissue grafts (amnion and chorion) and methods of preparing, preserving, and medical uses for the same, unpatentable.  The PTAB reasoned that “Patent Owner’s arguments do not persuade us that the ordinary artisan would not have combined [a journal paper] and [a U.S. patent publication] to arrive at the graft of claim 1.”

The case is captioned Musculoskeletal Transplant Foundation v. MiMedx Group, Inc., IPR2015-00664.
