PTAB Upholds Validity of Dr. Mark A. Barry’s Patents

September 12, 2016 – The Patent Trial and Appeal Board issued a final written decision in two inter partes reviews petitioned for by Medtronic, Inc., finding that Medtronic had not demonstrated by a preponderance of the evidence that the challenged claims of Dr. Mark A. Barry’s patents were unpatentable. The patents-at-issue are U.S. Patent Nos. 7,776,072 B2 and 7,670,358 B2, both entitled “System and method for aligning vertebrae in the amelioration of aberrant spinal column deviation conditions.” The cases are IPR2015-00780 and IPR2015-00783.
