District Court Grants Medline’s Motion to Dismiss C.R. Bard’s Inequitable Conduct Defenses

October 12, 2016 – On October 7, 2016, Judge Sharon Johnson Coleman granted Medline Industries, Inc.’s motion to dismiss C.R. Bard, Inc.’s inequitable conduct defenses, finding that C.R. Bard failed to plead with sufficient particularity both the intent and materiality prongs of such a defense. The patents-at-issue are U.S. Patent Nos. 8,746,452 and 9,283,352, which relate to the design of a tray for urinary catheters.

The case is pending in the Northern District of Illinois, Eastern Division; Medline Industries, Inc. v. C.R. Bard, Inc., Case No. 16-cv-3529.
