Rembrandt Diagnostics, LP v. Alere, Inc. et al.

October 19, 2016 – Judge Cathy Ann Bencivengo granted Defendants’ motion to stay pending their petitions for inter partes review because the case in district court was at an early stage. Discovery had recently commenced, there has been no hearing on claim construction, and no trial date has been set. The court found no indication that the stay was for a strategic advantage. Plaintiff Rembrandt Diagnostics, LP had sued Alere, Inc., among others, for patent infringement of U.S. Patent Nos. 6,548,019 and 8,623,291 relating to a device that collects and analyzes biological fluids in a single step. The case is pending in the Southern District of California and is captioned Rembrandt Diagnostics, LP v. Alere, Inc. et al., 3-16-cv-00698.
