Court Denies Andover’s and 3M’s Motions for Summary Judgment

Oct. 24, 2016 – The court denied motions for summary judgment from Plaintiff Andover Healthcare, Inc. and Defendant 3M Company in a patent infringement case over Andover’s patent, U.S. Patent No. 6,156,424, entitled “Cohesive Products.”  The technology at issue relates to cohesive bandages designed to adhere to themelves rather than using metal clips or pins to stay wrapped.  Cross motions by both parties on 3M’s laches and equitable estoppel defenses, 3M’s motion for summary judgment of indefiniteness, noninfringement, and no willfulness, 3M’s motion to preclude the Andover CEO from testifying as an expert, and 3M’s motion to preclude certain opinions of Andover’s damages expert were denied.  The case is number 13-843 and is pending before the United States District Court for the District of Delaware.
