Complaint filed by Nevro Corp. against Boston Scientific, et al.

On November 28, 2016, Nevro Corp. (“Plaintiff”) filed a complaint against Boston Scientific Corporation and Boston Scientific Neuromodulation Corporation (“Defendants”).  In the complaint, the Plaintiff is asserting infringement of U.S. Patent Nos. 8,712,533 (“the ‘533 Patent”), 9,327,125 (“the ‘125 Patent”), 8,359,102 (“the ‘102 Patent”), 9,480,842 (“the ‘842 Patent”), 9,333,357 (“the ‘357 Patent”), and 8,792,988 (“the ‘988 Patent).  The ‘533 Patent, the ‘125 Patent, the ‘102 Patent, the ‘842 Patent, the ‘357 Patent, and the ‘988 Patent are all assigned to the Plaintiff and are drawn to methods and/or devices for spinal cord stimulation (SCS) therapy.  The Plaintiff is asserting that the Defendants are infringing the asserted patents by manufacturing, using, offering for sale, selling, and/or importing one or more SCS systems.  The case remains pending and is captioned 16-cv-6830.
