December 12, 2016 – Arthrex sued Smith and Nephew and Arthrocare for infringement of multiple patents covering a surgical implant with a threaded suture anchor. At trial, the jury unanimously found that the Defendants had willfully infringement two of the patents, United States Patent No. 8,821,541 and 9,179,907. They also found that the patents were not invalid. The jury awarded $17 million in damages to Arthrex. Judge Roy Payne filed the judgement on December 12, 2016. The case was pending in the Eastern District of Texas and captioned, Athrex, Inc. v. Smith & Nephew, Inc. and Arthrocare, Corp., 2:15-cv-1047.
