December 28, 2016 — On December 21, 2016, the United States District Court for the Eastern District of Pennsylvania granted in part and denied in part Plaintiff Larry G. Junker’s motion to dismiss certain affirmative defenses and counterclaims filed by Defendants Medical Components, Inc. and Martech Medical Products, Inc. With respect to Defendants’ allegations of inequitable conduct and fraud, the Court denied Plaintiff’s motion because Defendants had pled sufficient facts. The Court granted in part Plaintiff’s motion to strike certain footnotes and paragraphs in Defendants’ amended pleadings because they exceeded the scope of amendments permitted by the Court.
The patent-at-issue is U.S. Patent No. D450,839, entitled, “Handle for Introducer Sheath.” The case is captioned Junker v. Medical Components, Inc., 2-13-cv-04606.
