January 4, 2017 – Defendants Life Technologies Corporation, Applied Biosystems, LLC, Ion Torrent Systems, Inc. and Thermo Fisher Scientific Inc. (“Defendants”) filed an amended answer and counterclaims to Plaintiff Illumina, Inc.’s second amended complaint. In response to Illumina’s allegation of infringement by Defendants of its patent, U.S. Patent Nos. 7,060,431, “Method of making and decoding array sensors with microspheres,” Defendants counterclaimed, alleging infringement of their patents, U.S. Patent Nos. 8,361,785, “Optical instrument comprising multi-notch beam splitter,” 8,921,098, “Instrument for monitoring DNA replication,” and 9,273,353 “Instrument for monitoring polymerase chain reaction of DNA.” The patents-at-issue relate to nucleic acid sequencing. The case is number 3:11-cv-03022 and is pending in the United States District Court for the Southern District of California.
