PTAB Finds Gold Standard Instruments’ Patent Claims Unpatentable

January 4, 2017 – The Patent Trial and Appeal Board issued a final written decision in the post grant review of Gold Standard Instruments, LLC’s patent, finding that Petitioner US Endodontics, LLC had shown by a preponderance of the evidence that certain claims were unpatentable.  The patent-at-issue is Gold Standard Instrument’s patent, U.S. Patent No. 8,876,991 titled “Dental and medical instruments comprising titanium.”  The Board based its finding of unpatentability on 35 U.S.C. §§ 112(a) and 102.  The case is PGR2015-00019 before the Patent Trial and Appeal Board.
