January 17, 2017 – The PTAB issued a final written decision regarding EMED’s U.S. Patent Number 8,961,476 titled “Sharps protector device for protecting a user from a sharp tip of a medical needle.” Petitioner Repro-Med Systems, Inc. demonstrated by a preponderance of the evidence that claims 1-8 and 10 of the ’476 patent are unpatentable. Claim 9 of the patent was not held unpatentable as anticipated. The case is pending before the Patent Trial and Appeal Board, IPR2015-01920.
