Magistrate Judge Recommends Denying Straumann’s Motion to Dismiss

January 24, 2017 – A magistrate judge in the United States District Court for the Eastern District of Texas recommended that Defendants Straumann Manufacturing, Inc., Straumann USA, Straumann Holding AG, Dental Wings, Institut Straumann AG, and Etkon GmbH’s motion to dismiss be denied.  Defendants contended that Plaintiff Zicore’s complaint alleging infringement of U.S. Patent No. 7,967,606 “Process for manufacturing custom crown copings and infrastructures” should be dismissed for failure to state a claim, alleging that the claims of the ’606 patent are directed to ineligible subject matter under 35 U.S.C. § 101.  Also at issue in the case are U.S. Patent Nos. 8,751,031 “System and method for mass custom manufacturing of dental crowns and crown components” and 7,690,920 “High strength substructure reinforcement for crowns and bridges.”  The case is 2:15-cv-01557.
