Wright Medical Technology, Inc. against KFX Medical Corporation

On April 6, 2017, Wright Medical Technology, Inc. (“Plaintiff”) filed a complaint for declaratory judgment against KFX Medical Corporation (“Defendant”).  In the complaint, the Plaintiff is asserting non-infringement and invalidity of U.S. Patent Nos. 7,585,311 (“the ‘311 Patent”), 8,100,942 (“the ‘942 Patent”), and 8,109,969 (“the ‘969 Patent”).  The ‘311 Patent, the ‘942 Patent, and the ‘969 Patent are all assigned to the Defendant and are drawn to systems and methods for attaching soft tissue to bone.  The Plaintiff is asserting that its products, including its knotless suture anchors, do not infringe the asserted patents.  The Plaintiff is further asserting that the ‘311 Patent, the ‘942 Patent, and the ‘969 Patent are invalid under 35 U.S.C. §§ 102 and/or 103 over various patent and non-patent documents. The case remains pending and is captioned 1-17-cv-00384.
