April 10, 2017 – Chief United States Magistrate Judge Mary Pat Thynge issued a Report and Recommendation on April 6, 2017, recommending granting in part and denying in part Stryker Corp.’s motion to dismiss Zimmer Surgical’s complaint for failure to state a claim of direct infringement, indirect infringement, willful infringement and/or infringement of specific dependent claims in Zimmer Surgical, Inc. v. Stryker Corp., C.A. No. 16-679-RGA-MPT (D. Del.). The patent at issue is U.S. Patent No. RE44,920, entitled “High Volume Liquid Waste Collection and Disposal System.” The technology at issue relates to waste management systems that simplify fluid collection in operating rooms.
