PTAB Declines to Rehear Final Written Decision on Nobel Biocare’s Patent

May 15, 2017 – Patent Trial and Appeal Board Administrative Patent Judge Christopher G. Paulraj issued a decision on May 10, denying a request for rehearing by Patent Owner Nobel Biocare Services AG to reconsider the unpatentability finding in the Board’s Final Written Decision of challenged claims 1-5 and 19 of U.S. Patent No. 8,714,977, entitled “Condensing Skeletal Implant That Facilitate Insertions” in Case IPR2015-01786.  APJ Paulraj, along with panel members William V. Saindon and Tina E. Hulse, declined to reconsider the claim construction of “coronal region having a frustoconical shape” in the Final Written Decision because Patent Owner was making a brand new argument in the request for rehearing that was not part of the record.  Nobel Biocare’s ’977 patent is directed generally to dental bone anchorage implants.
