Judge Grants Defendant Alcon LenSx Inc.’s Motion to Strike Discovery Response

May 18, 2017 –– District Judge James V. Selna granted Defendant Alcon LenSx Inc.’s motion to strike Plaintiff Femto-Sec Tech, Inc.’s supplementary interrogatory response and precluded Plaintiff from asserting a conception date at trial earlier than the date disclosed in its preliminary infringement contentions, on May 16, 2017.  This lawsuit involves U.S. Patent Nos. 5,720,894 (the “’894 patent”), 6,414,320 (the “’320 patent”), 6,621,040 (the “’040 patent”), 6,150,630 (the “’630 patent”), and 6,268,586 (the “’586 patent) directed towards ultrashort pulse laser technology comprising medical applications for humans and animals, including medical devices and cosmetic applications, and biological treatments for plants.  The case, captioned Femto Sec Tech Inc. v. Alcon LenSx Inc., 8-15-cv-00624, is pending in the United States District Court for the Central District of California Southern Division.
