On June 7, 2017, Plaintiffs Confluent Surgical, Inc., Integra LifeSciences Corporation, and Integra LifeSciences Sales LLC filed a complaint for patent infringement against Defendant, HyperBranch Medical Technology, Inc. on June 6, 2017 in the United States District Court for the District of Delaware. The lawsuit relates to HyperBranch’s Adherus AutoSpray Dural Sealant and/or the applicator for its Adherus AutoSpray Extended Tip (ET) Dural Sealan, which allegedly infringe the patents at issue by constituting at least a material component of at least one claim of the patents-in-suit and which are not staple articles of commerce suitable for substantial noninfringing use. The patents at issue are U.S. Patent Nos. 9,517,478, 8,210,453, 8,616,468 and 9,101,946, all directed to a “Spray Applicator”, and 8,876,021 and 8,033,483, both directed to a “Silicone Spray Tip”. The complaint has been given Civil Action No. 1-17-cv-00688 (D. Del.).
