District Court Grants Permanent Injunction over Curvilinear Peristaltic Pump

On June 12, 2017, District Judge Stanley R. Chesler granted permanent injunction against Defendants ACTA Medical, LLC, John Harry Brewer, and Evan Brewer (collectively, the “Defendants”)  in the United States District Court for the District of New Jersey on June 8, 2017.  Plaintiffs, Moof Inc., Curlin Medical Inc., and Zevex, Inc., filed a Complaint on May 2, 2016 and an Amended Complaint on June 5, 2017 against the Defendants, alleging patent infringement, trademark infringement, and unfair competition. The patents-at-issue are U.S. Patent No. 6,371,732, entitled “Curvilinear Peristaltic Pump,” and U.S. Patent No. 6,164,921, entitled “Curvilinear Peristaltic Pump Having Insertable Tubing Assembly.”  The case is captioned Curlin Medical Inc. et al v. ACTA Medical, LLC et al, 2-16-cv-02464.
