On June 26, 2017, Plaintiff Acuity Innovation and Design, LLC filed a complaint for a patent infringement against Defendants Arizona Dental Professionals, P.C., d/b/a Arrowhead Creekside Dental; T. Phillip Shin and Jane Doe Shin; and Thomas W. Rogers and Jane Doe Rogers on June 23, 2017 in the United States District Court for the District of Arizona. The Plaintiff alleges that the Defendants infringe on the Plaintiff’s patent by installing OVC products made available by Rhondium (a non-party), performing all steps contained in each element of at least one claim of the patent, and continuing to sell and offer for sale in Arizona products embodying the dental prosthesis fabrication and placement system and methods as set forth in the patent. Plaintiff also claims that each and every element of at least one claim of the patent is embodied in the method used to install Rhondium’s OVC products. The patent at issue is U.S. Patent No. 6,935,862, directed to a “Dental Prosthesis Fabrication and Placement System and Associated Methods”. The complaint has been given Civil Action No. 2:17-cv-01986-JZB (D. Ariz.).
