District Court Denies in Part and Grants in Part Motion to Compel Discovery Over Medical Imaging Systems

On June 28, 2017, Magistrate Judge Jacqueline S. Corley denied Plaintiffs Karl Storz Endoscopy-America, Inc.’s motion to compel Defendants Stryker Corporation et al to produce an unredacted copy of their advice of counsel letter on June 23, 2017 in the United States District Court for the Northern District of California (San Francisco). On the same case, Magistrate Judge Corley granted Plaintiffs’ motion to compel Defendants to produce an unredacted copy of their counsel’s patent screening report. The patents-at-issue are the following U.S. Patents: Nos. 7,471,310 and 7,821,530, both entitled, “Intelligent Camera Head”; No. 7,844,657, entitled “System For Controlling Medical Devices”; No. 8,069,420, entitled “System For Controlling the Communication of Medical Imaging Data”; and No. 8,439,821, entitled “System and Method for the Central Control of Devices Used During an Operation.”  The case is captioned, Karl Storz Endoscopy-America, Inc. v. Stryker Corporation et al, 3-14-cv-00876.
