Federal Circuit Affirms ITC Infringement Finding On Dental Patents

July 20, 2017-The Federal Circuit affirmed an ITC ruling that a dental supply company and its U.S. subsidiary imported dental implants that infringe patents owned by Nobel Biocare Services and which prohibited importation of the products into U.S. In a per curiam decision, the panel affirmed the 2016 ITC decision, which concluded that JJGC Indústria e Comércio de Materiais Dentários SA and subsidiary Instradent USA Inc. violated Section 337 of the Tariff Act based on their importation of the surgical components in question. The relevant patent at issue is 8,714,977, which covers “condensing skeletal implant that facilitate insertions.” The case is Instradent USA Inc. v. ITC, case number 16-2336, in the U.S. Court of Appeals for the Federal Circuit.
