December 19, 2017 – The Patent Trial and Appeal Board (“PTAB”) granted Petitioner Cook Group Inc. and Cook Group Medical LLC’s (“Cook”) request for rehearing of the decision to institute inter partes review of Boston Scientific Scimed, Inc.’s patent. The PTAB had instituted review of claims 1-19, but did not institute review of claim 20. Based on Cook’s request for rehearing, the PTAB reconsidered the scope of claim 20 and found that Petitioner had established a reasonable likelihood that claim 20 is unpatentable. The patent-at-issue is U.S. Patent No. 8,709,027 titled “Device and method for through the scope endoscopic hemostatic clipping,” and the case is IPR2017-00134.
