January 12, 2018 – Synaptive Medical Inc. filed a petition for inter partes review of Claims 1-19 of Patent No. 9, 468, 360, “Video System for Viewing an Object on a Body.” Patent ‘360 is owned by Karl Storz Endoscopy-America (“Storz”), and was the subject of an infringement action filed by Storz in July 2017 against Synaptive, wherein Storz accused Synaptive’s “BrightMatter Servo” system of infringing their patent. Patent ‘360 pertains to an endoscopic camera head and lens outside of the body during surgery, claiming to offer an improvement over the existing bulky surgical microscopes presently used. Synaptive’s petition contends that Claims 1-19 are unpatentable under 35 U.S.C. § 103 over the prior art.
The related case is captioned Karl Storz Endoscopy-America, Inc. v. Synaptive Medical Inc., No. 1:17-cv-05607-JMP and is pending in the Southern District of New York.
