On June 27, 2018, LifeNet Health (“Plaintiff”) filed a complaint against RTI Surgical, Inc. (“Defendant”) asserting infringement of U.S. Patent Nos. 6,569,200 (“the ‘200 Patent”), 9,579,420 (“the ‘420 Patent”), 9,585,986 (“the ‘986 Patent”), 6,458,158 (“the ‘158 Patent”), and 8,182,532 (“the ‘532 Patent”). Each of the asserted patents is assigned to the Plaintiff and is drawn to plasticized dehydrated or freeze-dried bone and/or soft tissue products, and/or a composite bone graft for implantation in a patient. The Plaintiff is asserting that the Defendant is infringing each of the asserted patents by using, importing, manufacturing, selling, and/or offering for sale (i) a porcine dermis tissue product under the brand name Fortiva, (ii) a bone product under the brand name Capistrano Cervical Allograft Spacer System, (iii) a bone product under the brand name Puros-S2 cervical, (iv) a bone product under the brand name AlloQuent-S, (v) a bone product under the brand name CeSpace Cancellous Bone, (vi) a bone product under the name Cornerstone ASR-Cortical Cancellous Block, and/or (vii) a bone product under the brand name Elemax™ Cortical Cancellous Spacer.
