Ethicon LLC v. Intuitive Surgical, Inc.

On December 28, 2018, the court issued a claim construction opinion in Ethicon LLC v. Intuitive Surgical, Inc., construing claims of U.S. Patent Nos. 8,479,969 (“the ‘969 Patent”), 8,616,431 (“the ‘431 Patent”), 8,991,677 (“the ‘677 Patent”), 8,998,058 (“the ‘058 Patent”), 9,084,601 (“the ‘601 Patent”), 9,113,874 (“the ‘874 Patent”), and 9,585,658 (“the ‘658 Patent”). As a result of the claim construction for the term “actuator arrangement”, the challenged ‘601 Patent claims were found invalid as indefinite. The Patents, which are owned by the Plaintiff, are drawn to surgical instruments. The case remains pending and is captioned 1:17-cv-00871 (D. Del.).
