Institution Denied in Catheter Inter Partes Review

On January 17, 2019, the USPTO’s Patent Trial and Appeal Board (“Board”) denied institution of IPR2018-01495 filed by Medtronic, Inc. (“Petitioner”). In IPR2018-01495, the Petitioner challenged claims 15 and 27 of U.S. Patent No. 6,638,268 (“the ‘268 Patent”) as obvious under 35 U.S.C. § 103. The ‘268 Patent is owned by Niazi Licensing Corporation and is drawn to catheters used to introduce devices, such as pacing leads, into the vasculature of the heart. The Board denied institution because the petition was time barred under 35 U.S.C. § 315(b).
