Complaint filed by Abbott Cardiovascular

On January 28, 2019, Abbott Cardiovascular Systems, Inc. and Evalve, Inc. (“Plaintiffs”) filed a complaint against Edwards Lifesciences Corporation and Edwards Lifesciences, LLC (“Defendants”) for infringement of U.S. Patent Nos. 6,752,813 (“the ‘813 Patent”), 7,288,097 (“the ‘097 Patent”), 7,563,267 (“the ‘267 Patent”), 7,736,388 (“the ‘388 Patent”), and 8,057,493 (“the ‘493 Patent”). The Patents are owned by the Plaintiffs and are drawn to methods, systems, and devices for engaging and connecting soft tissue as part of heart surgeries. Plaintiffs allege that these patents cover their MitraClip device.

The Plaintiffs are asserting that the Defendants are infringing the Patents by manufacturing, exporting, using selling and offering for sale their PASCAL transcatheter mitral valve repair system.

The case remains pending and is captioned 1:19-cv-00149 (D. Del.).
