Federal Circuit finds Tyco Surgical Blade patents invalid

December 5, 2014 – Tyco Healthcare and U.S. Surgical sued Ethicon Endo-Surgery alleging that Ethicon’s ultrasonic cutting and coagulating surgical devices infringe. Tyco’s U.S. patents, 6,682,544; 6,063,050; and 6,468,286, which are directed to ultrasonic curved and tissue-coagulating blades for surgery. The Federal Circuit affirmed the Connecticut District Court’s holding that Tyco’s claims were anticipated by Ethicon’s prototype curved surgical blade under 102(g), but reversed its findings that the claims were not obvious, for the same reason. The case is Tyco Healthcare Grp., et al. v. Ethicon Endo-Surgery, Inc. 2013-1324 and -1381 (Fed. Cir. 2014).
