Court Denies Allen Medical’s and Scheurch’s Motions to Compel

May 26, 2016 – Plaintiff Allen Medical Systems, Inc.’s (“Allen Medical”) and Defendant Scheurch Corp.’s (“Scheurch”) motions to compel were denied by the court.  Allen Medical sought various relief from the court which was denied as “largely moot”; and the court found Scheurch’s motion to compel to be seeking redress in anticipation of plaintiff’s violation of discovery obligations.  The patents-at-issue are U.S. Patent Nos. 6,622,980 and RE41412, titled respectively, “Socket and rail clamp apparatus,” and “Leg holder system for simultaneous positioning in the abduction and lithotomy dimensions.”  The case is number 15-13024-GAO and is pending before the United States District Court for the District of Massachusetts.
