On December 18, 2017, the USPTO’s Patent Trial and Appeal Board (“Board”) issued a final decision in an inter partes review regarding a petition filed by Cook Group Inc. and Cook Medical LLC (“Petitioner”) over the patentability of claims 1-20 recited in U.S. Patent No. 8,709,027 (“the ‘027 Patent”). The ‘027 Patent, which is owned by Boston Scientific Scimed, Inc., is drawn to a device and method for through the scope endoscope hemostatic clipping. In the decision, the Board granted in part, and denied in part the petitioner’s request for rehearing of the written decision denying institution of the inter partes review. The inter partes review remains pending at the Board and is captioned IPR2017-00134.
